Terms of Service (EULA)

1. Acceptance of Terms

By downloading, installing, or using DriveSmart UK ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

2. Description of Service

DriveSmart UK is a companion app designed to help learner drivers and driving instructors manage lessons, track progress, and prepare for the UK driving test. The App provides features including:

  • Lesson booking and scheduling
  • Progress tracking and skill assessments
  • Practice route generation
  • Driving session logging
  • Communication between learners and instructors

3. Subscriptions and Payments

3.1 Free and Paid Plans

DriveSmart UK offers a free Starter plan with limited features. Additional features are available through paid subscriptions and one-time purchases:

  • Pro (£4.99/month): Unlimited practice routes, detailed score breakdowns, AI coaching tips, progress trends, test centre routes, and priority support.
  • Test Ready (£14.99 one-time, requires Pro): 8-week structured plan, mock test routes, weak-spot drills, and test countdown tracker.

3.2 Billing and Renewal

All purchases are processed through Apple's App Store. Payment is charged to your Apple ID account at the time of purchase confirmation. Pro subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

3.3 Managing and Cancelling Subscriptions

You can manage or cancel your subscription at any time through your Apple ID Account Settings in the App Store, or through Settings > Apple ID > Subscriptions on your device. Cancellation takes effect at the end of the current billing period — you will retain access to Pro features until that date. No partial refunds are provided for the remaining period.

3.4 Price Changes

We may change subscription prices from time to time. Any price changes will take effect at the start of the next billing period following notice to you. If you do not agree with a price change, you may cancel your subscription before the change takes effect.

3.5 Refunds

Refund requests are handled by Apple in accordance with their refund policies. To request a refund, visit reportaproblem.apple.com.

4. User Accounts

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

5. User Conduct

You agree not to:

  • Use the App for any unlawful purpose
  • Impersonate any person or entity
  • Interfere with or disrupt the App's functionality
  • Attempt to gain unauthorized access to any systems
  • Upload malicious content or code
  • Use the App while driving or operating a vehicle

6. Driving Safety Disclaimer

Important: DriveSmart UK is a supplementary learning tool and does not replace professional driving instruction. Always follow the guidance of your qualified driving instructor.

Never use the App while driving or operating a vehicle. Any driving session tracking features should only be operated by a passenger or used to review data after completing your journey.

7. Intellectual Property

The App and its original content, features, and functionality are owned by DriveSmart UK and are protected by international copyright, trademark, and other intellectual property laws.

8. Third-Party Services

The App may contain links to or integrate with third-party services (such as mapping services). We are not responsible for the content or practices of these third-party services.

9. Limitation of Liability

To the fullest extent permitted by law, DriveSmart UK shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the App.

We do not guarantee that the App will be error-free or uninterrupted, or that defects will be corrected.

10. Indemnification

You agree to indemnify and hold harmless DriveSmart UK and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

11. Termination

We may terminate or suspend your account and access to the App immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

You may delete your account at any time through the App settings or by contacting support.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the new Terms on this page and updating the "Last updated" date.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
